Activision will take EA to court over claims that EA stole Infinity Ward founders Jason West and Vince Zampella from their ranks. Judge Elihu Berle has pushed the case forward, stating that Activision had supplied enough evidence to justify the court case.

Activision’s lawyer Steven Marenberg said (via Bloomberg): “We’re pleased with the ruling and look forward to proving our case at trial.”

Last year West and Zampella left Activision and formed their own studio Respawn Entertainment, working with EA.

This isn’t the only court case between the two parties. Last year Zampella,West and 38 ex Infinity Ward employees took Activision to court over unpaid bonuses.
